DMCA Copyright Policy

1. Our Commitment to Copyright

Clavisage respects the intellectual property rights of others and expects users of our platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond promptly to claims of copyright infringement that are reported to our designated DMCA agent.

2. Reporting Copyright Infringement

If you believe that content available on or through Clavisage infringes one or more of your copyrights, please submit a written notice ("DMCA Takedown Notice") to our designated DMCA agent containing all of the following information required under 17 U.S.C. § 512(c)(3):

  1. Physical or electronic signature — A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work — A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notice, you may provide a representative list.
  3. Identification of the infringing material — A description of the material you claim is infringing and information reasonably sufficient to allow us to locate the material (e.g., the URL or specific location on the Clavisage platform).
  4. Your contact information — Your name, mailing address, telephone number, and email address.
  5. Good faith belief statement — A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy and perjury statement — A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

4. Our Response Process

Upon receipt of a valid DMCA Takedown Notice, we will:

  • Promptly remove or disable access to the allegedly infringing material
  • Notify the user who uploaded the material that it has been removed
  • Provide the user with a copy of the takedown notice (with your contact information)
  • Inform the user of their right to submit a counter-notification

5. Counter-Notification Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our DMCA agent. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which you reside (or the Western District of Texas if outside the United States), and that you will accept service of process from the person who submitted the original takedown notice.

Upon receipt of a valid counter-notification, we will forward it to the original complainant and restore the removed content within 10–14 business days unless the complainant files a court action to restrain reinstatement.

6. Repeat Infringer Policy

Clavisage will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We reserve the right to decide, at our sole discretion, whether a user qualifies as a repeat infringer under this policy.

7. Misrepresentation Warning

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys' fees. Please ensure that your claim is accurate before submitting a takedown notice.
